Partner Andy Freeman, who, along with Lauren Kelleher, represents the National Association of Postal Supervisors in its lawsuit against the United States Postal Service, spoke to the NAPS executive board on April 10 regarding the status of the lawsuit.
The complaint highlights the Postal Service’s violation of the Postal Reorganization Act’s requirements for an “adequate and reasonable” supervisory differential. In 2019-2021, the Postal Service failed to pay over 10,000 supervisors of carriers and clerks at least 5% more than over 100,000 carriers and clerks. The underpaid supervisors and managers are seeking an upward adjustment in their 2019-2021 pay (and in retirement pay based on those years) to compensate for the lack of an adequate differential.
Other issues addressed by the lawsuit include the Postal Service’s failure to assure that Executive Administrative Schedule employees received compensation comparable to the private sector and that the Postal Service refused to recognize NAPS as representing postmasters and most “Headquarters” and “Area” EAS employees.
Having won a major victory in the Court of Appeals for the D.C. Circuit in 2022, Andy and Lauren completed discovery in the case and are in the midst of the briefing of cross-motions for summary judgment.
“We are optimistic that the trial court will agree with us that salaries for EAS employees generally, and for supervisors and managers of carriers and clerks in particular, needed to be substantially higher to comply with the requirements of Title 39,” Andy explained.
