Brown, Goldstein & Levy partner Eve Hill, one of the nation’s foremost disability rights attorneys, provided key legal insight in a recent DisabilityScoop article. In the story, “Justice Department Backs Off Disability Rights Enforcement,” Eve discussed the risk to individuals with disabilities after federal officials reversed their long-held positions on the rights of people with disabilities to access home and community-based services in multiple court cases.
The U.S. Department of Justice (DOJ) pulled out of one disability rights case and altered its argument in another, fueling concerns of institutionalization and other changes that could negatively impact the lives of individuals with disabilities across the nation.
“These are very significant reversals of DOJ’s position,” Eve told DisabilityScoop. “We are at risk of returning to the terrible conditions people with disabilities were forced to endure when they were locked away out of sight and out of mind.”
The actions of the DOJ in these cases come after its Office of Legal Counsel issued a memo in June stating that neither the Americans with Disabilities Act nor Section 504 of the Rehabilitation Act “require states to treat mentally disabled patients in the most integrated setting appropriate to their needs.”
